This disclaimer by the seller in no way affects the terms of the manufacturer's warranty if any. Title to goods herein being purchased is retained by the seller until goods are paid for by the purchaser and at that time title passes to purchaser. If goods herein being purchased are being purchased for purposes of export, purchaser must obtain from the Federal Government certain export documentation before shipping to a foreign country. ASSUMPTION OF RISK:
Customer recognizes that the use of computer products involves a substantial
risk of loss of stored data, and that industry standards dictate Customer's
systematic use, in conjunction with any central processing unit, of products
which provide comprehensive backup of data so as to prevent such loss. In
addition to the risks assumed by Customer hereunder, customer assumes all risk
of loss of its data from any and all causes or in any way related to or resulting
from the sale or service of products by INTERWEB Computer Solutions, and
customer hereby releases INTERWEB Computer Solutions from liability for
any loss of customer's data.
FORCE MAJEURE:
INTERWEB Computer Solutions shall not be liable for any delay or inability
to perform any services due to any unavailability of parts, fire, unusually
severe weather, embargoes, acts of God, acts of any public authority or
sovereign government, delays or defaults caused by public carriers, or
any other causes beyoned the control of INTERWEB Computer Solutions.
LIMITATION OF LIABILITY:
INTERWEB Computer Solutions shall not be liable for any indirect incidental,
special or consequential damages, whether in an action in contract or tort
(including negligence and strict liability), such as but not limited to, loss
of anticipated profits or benefits resulting from its performance or any
failutre to perform under this agreement, even if INTERWEB Computer Solutions
has been advised of the possibility of such damages. In no event will INTERWEB's
liability exceed the price paid for repair or replacement of any item of
equipment which is damaged in connection with the service provided hereunder.
